Thankfully, jury ruled in favor of the rider. 183K in damages awarded to him.
okay, yea, buddy was out having fun and passed in marked no passing zones. fair enough. But bikes accelerate WAY faster then cars, and what is a ‘no passing zone’ in a car is a 2 car pass on a bike. and he was waiting for a clear shot.
but I digress
“Edwards also said he accidentally “bumped” the back end of Wilkens’ motorcycle as a result of possible “brake fade””
brake fade. after a very short chase in a
camaro
. get fucked nitwit. (jury agrees there)
“[The agency] is disappointed with the (trial) outcome and feels the actions of our troopers clearly did not violate established procedures or tactics. In situations like these, officers have milliseconds to make what may be life-or-death decisions and those officers should be shielded from the liability of civil damages.””
you just REAR ENDED a motorcycle and are POINTING A GUN at him. so you then decide to kick him hard enough to give him “
broken left clavicle, a fractured rib and other injuries”
That ‘agency’ needs to be torn down and rebuilt.
this pisses me off. A LOT.
Do me a favor. read the whole article. it does mention that “
he [
the rider]
did not see the Camaro’s flashing blue-and-red lights — which are embedded in the car’s grille — through a small, rear-view mirror. He testified that when he pulled over for Edwards, he expected to receive a “deserved” speeding ticket.”
While i dont agree with the ‘tight fitting helmet portion’ [i’m more inclined to believe that he had headphones and music playing] in no way does it justify that reaction from the cop.

It sounds like somebody got a little hot headed when their
authoritay
wasn’t immediately respected.
Have you ever seen this video of a cop pushing over a cyclist, and then arresting them for “resisting” arrest?

There is plenty of blame on both sides. The guy riding knew he had a cop behind him. He thought he could outrun the cop.
Should the cop have hit him, no probably not. Should he have kicked him, no but would you rather get tased?

Jesus fuck. Does this mean Oregon doesn’t have a no-chase policy for bikes? They need to get on that... Especially since the only initial offense was illegally passing the white truck and minor speeding.

read the article. guy didnt notice and was coming to a stop
when
he did.
I wouldnt think a camaro is a cop car. I honestly would have thought some joker was pretending to be a cop.
(and frankly, if i’m riding fast, i dont worry whats happening behind me. i worry what happening ahead of me. )
there was no need for the taser or the kick or anything! the guy was already down and clearly surrendering.

I did read the article and watched the vid. I still don’t believe that he had zero knowledge a cop had sirens going and lights on chasing him for over three minutes.

okay, fair enough.
now, looking at it from the ‘hes gunna run part’
you REALLY think that a 600CC wouldnt dust a camaro like its a ford model t? if he wanted to run, he would have been gone.
annd taking a closer look at the video, the bike looked to be an a older aprilia RSV
that is a 1000 suoper bike that will do 60mph-80mph in 3.8 seconds, and 80-100 in 4.3. if he wanted to get away, he would have done so no problems

Not saying the cop was right, but there wouldn’t be any problems if the biker didn’t break laws in the first place that are there for a reason.
If his speeding wasn’t that bad, cop may or may not even bother. But passing in yellows and not leaving a whole lot of room after the pass to get back in, is just dumb.
That and most people who run are already hyped up and have bad intentions, you make the .1 second decision. Cops have been shot and killed in that amount of time.
Two sides to the coin, cop shouldn’t have kicked him either and kept his distance.
Also - if you’re running from the cops on a bike and are stopped at a light, pretty sure they have every right to bump you off. Just as they pit maneuver.

The bike could out run the cop, of that I have no doubt. Could the rider? Maybe.

No chase rules should be implemented everywhere unless there is a known felony being committed. No need to put others at risk. One person speeding is enough risk.

yes, because you’ve NEVER had a close pass in your life. ever.
or EVER crosses the double yellows. EVER. nope, your a good little grandma always driving the speed limit to church right?
and remember, what may seem ‘close’ to a car is actually a HUGE amount of room for a bike. Honestly, none of his passes looked ‘close” passing over the double yellow, again, a bike can pass WAY faster then a car can.

“Looks”, I in no way condone what the cops did, but you were not there, I wasn’t there.
Have you stopped people and asked for I.D.? I have. Wondering if they are going to pull a Gun.
If you break the law, you want to get caught.
Sounds like some Darwin Awards need to be passed out.

According to trial testimony, Edwards did not know the unmarked Chevrolet Camaro he was driving at the time was equipped with the video system.
seeeeeee this is why cruiser cams & body cams are great ideas

At first I thought he was eluding but realized after reading the article the cop was in an unmarked Camaro. A Camaro riding your ass is like par for the course so no way to assume it was a cop. And he could’ve EASILY outran the cop if he had actually been trying. When I noticed him slowing down a lot I knew he wasn’t running. Cop was wrong here for sure.

Yeah... that motorcycle rider was riding like he had no idea the cop was behind him. I’m 100% sure if the motorcyclist wanted to lose the cop, he could have.
While that motorcyclist deserved to get a huge speeding ticket as well as a couple of other tickets for passing when there was a solid yellow line, that doesn’t justify the cop ramming the motorcycle and going Rambo on the guy... especially since the motorcyclist’s actions and body language all said that he was complying once he realized a cop was pulling him over.
That’s what I got out of the video.
